I have recently been contacted by Twentieth Century Fox and told to remove the Simpsomaker, so I guess it will have to be removed here soon?

The letter goes...

To Whom It May Concern:

As you are aware, Twentieth Century Fox Film Corporation ("Fox") and its related entities own intellectual property rights in and to the "THE SIMPSONS" television series (hereinafter the "Fox Property"). These rights include the exclusive rights to all images, scenes, plots, characters and other elements appearing in or related to the Fox Property.

We have recently become aware that you have "Fun Animation" on your website entitled the "Simpsomaker" (hereinafter "Infringing Items").

It is clear that your use of the "Simpsomaker" on your website is likely to cause consumers to improperly believe that Fox has licensed, supported or endorsed your use and distribution of this animation. We further believe that such is an obvious attempt to improperly trade off of the notoriety of the Fox Property. Your unauthorized use not only undermines standards of fair dealing and proper methods of competition, but also constitutes trademark infringement in violation of federal law, including Section 43(a) of the Lanham Act, as well as state and common law provisions including fraud and misrepresentation.

We hereby must request that you respect Fox's intellectual property rights and refrain from any further activities which would undermine our efforts to maintain Fox's rights. We, therefore, demand that you immediately do the following:

1. Cease all use, sale or other dissemination of the Infringing Items;
2. Destroy all Infringing Items in your possession, custody or control;
3. Confirm in writing no later than January 26, 2006 that you shall fully and promptly comply with each of the foregoing demands.

You should be aware that Fox takes its responsibility for the protection of its properties and the legitimate rights it has granted to authorized users very seriously by prohibiting and actively policing unauthorized uses. Fox, in fact, has taken action against others engaged in these types of activities, and has obtained monetary compensation and secured other remedies against them.

Should you refuse to comply with any or all of the above demands by the close of business on January 26, 2006 we will consider exercising all remedies available to Fox, including taking action against you without further notice to you.

We trust that this letter has made clear Fox's position with respect to the unacceptable use of its proprietary materials by third parties.
